Mohammed Abacha, the son of the late
military head of state General Sani Abacha, has been ordered by the Supreme
Court to return to the Abuja High Court to face a 123-count charge for keeping
properties allegedly stolen from the federal government by his father, amongst
other charges.
The court declared that the immunity of
the father does not apply to the son, and that even the father’s immunity
expired upon his exit from office.
The high court had rejected Mohammed’s
application to dismiss the charges, after which he appealed, but his appeal was
also rejected. Mohammed had argued that his father’s immunity should be
extended to him.
He also argued that having forfeited
some of the family's properties confiscated by the government, he was exempted
from prosecution.
The Federal Government had issued a123-
count charge which included conspiracy and receipt of stolen funds.
